Retail Customers [ TERMS / CONDITIONS ( TOS ) ]

This agreement shall govern participation in the FavoriteTraffic.com Guaranteed Visitors program. By participating in the Program you are agreeing to be bound by these Terms and Conditions. The term 'customer' shall refer to any individual or entity who accepts the terms and conditions of this Agreement by submitting the Program registration.
The term ' landing page ' shall refer to the page of your site in which FavoriteTraffic.com is sending visitors.
The term 'site' shall refer to all pages within the same URL / subfolder in which FAVORITETRAFFIC.COM is sending traffic.

All orders that are placed through FavoriteTraffic.com are subject to the following terms and conditions. By placing an order it is understood that you have read, comprehended and agreed with these terms.

These TERMS and CONDITIONS ( TOS ) are an agreement between you ("CUSTOMER, CLIENT") and FAVORITETRAFFIC.COM ("us"). They MUST be read and understood.

We thank you for your business and wish you extreme success. We hope that you will benefit from your traffic purchase and enjoy a long relationship with us.

PARTICIPATION:

FavoriteTraffic.com shall have absolute discretion as to whether or not it accepts a particular customer or site for traffic purchase fulfillment.

1. FavoriteTraffic.com will not deliver visitors to the sites containing content that is not appropriate for viewing by a general audience, unless Adult / Casino Oriented traffic was purchased. The following are examples (including but not limited to) of the type of sites we will not deliver visitors to:

• Sites containing or linking to software piracy
• Sites containing or linking to any form of illegal activity (i.e., how to build a bomb, hacking, 'phreaking', etc.)
• sites with gratuitous displays of violence, obscene or vulgar language, and abusive content or content which endorses or threatens physical harm.
• Sites promoting any type of hate-mongering (i.e., racial, political, ethnic, religious, gender-based, personal, etc.)
• Sites that participate in or transmit inappropriate newsgroup postings or unsolicited email (spam).
• Sites promoting any type of illegal substance or activity sites with illegal, false or deceptive investment advice and money-making opportunities.
• Sites with any type of content reasonable public consensus deems to be improper or inappropriate.

All campaigns are considered active the moment the first visitor ( Traffic ) is delivered to the client site.

2. Your Landing Page may not contain any other Popup windows,audio,noises,sounds, (unless you have purchased the Unlimited Popup options). Any additional window/audio,sounds generated by your landing page shall be considered a popup window, including popups, pop-behinds, or exit popup windows. If a popup window is installed on the landing page at any time, FavoriteTraffic.com may stop the campaign and you will not be entitled to a refund.

3. Your Landing Page can not have background music/audio or sounds unless "unlimted popup" traffic has been purchased.

4. Your Landing Page can not contain scripts that alter users browser settings.

5. Your Landing Page can not contain any frame breaking codes.

6. To insure compliance with these terms and conditions, any Customers that change their landing page content after approval for traffic delivery MUST notify FavoriteTraffic.com of the changes in writing IMMEDIATELY. If your landing page is changed during the campaign such that it includes inappropriate content,popups,sounds/audio when not permitted, FavoriteTraffic.com may stop your campaign immediately. In this case, you will not be entitled to a refund.

PAYMENT:

All customers are required to pay one-hundred (100%) percent of the cost of the campaign before its activation. FavoriteTraffic.com reserves the right to set and negotiate specific payment terms on a Customer-by-Customer basis.
DATA REPORTING (STATS):

All Campaigns purchased on the Network are served, tracked and reported by us. We use a state of the art tracking system to track your ad campaign. Each order is given a unique campaign ID which is used to track visitors to your site by day/time. When we provide an ad view, FavoriteTraffic.com points the visitors to this campaign ID.

Client is financially responsible for every hit / visitor delivered to their website.
CANCELLATION:
If you decide to cancel your order, You agree to pay for all traffic that was sent to you plus you agree to pay a cancellation charge equal to 25% of the cost of the purchased campaign payable through Paypal. Note you must have your campaign on PAUSE and provide us with your original payment information in order for us to promptly cancel your order. Refunds will be made within 7 business days. Your refund will be for 75% of your campaign order dollar amount minus the value of any traffic previously sent for that campaign.
If a cancellation occurs due to a violation of Terms and Conditions, you will not be entitled to any refund.

All traffic/visitors will be delivered to the website address submitted with the order.
In the event that there is an error with the submitted URL, the Client will not hold FavoriteTraffic.com or it's Partner Sites responsible for the error. Any traffic delivered to a Client's site reflecting the above error, will not be credited or entitled to a refund.

In the event that the Client's site becomes unavailable for any reason ("server is down or unavailable, timed out, or shows to be active but with internal server errors, 404 errors and other types of common or uncommon errors associated with the internet and its underlying infrastructure"), the Client will not hold FavoriteTraffic.com or its Partner Sites responsible for these errors. All / Any traffic delivered to the Client's site during this down time will not be credited or refunded.

In the event that any of the above errors occur including any errors not listed but clearly intended, the client may also submit in writing, a request for the campaign to be placed on hold. Upon resolution of the problem the held campaign will continue. Any traffic previously sent will not be credit or refunded.

The client understands that if the visitor viewing the landing page closes it before it finishes loading (due to network bandwidth, high impact graphics, animation or lack of interest on the visitors part etc.), IT WILL COUNT AS A VISITOR SENT FROM OUR SYSTEM, WE HAVE SENT A VISITOR TO YOUR SITE AND HAVE THEREFORE FULFILLED OUR OBLIGATION. It is important to note that this scenario may not appear in your website statistics. FavoriteTraffic.com cannot control the acts of the individuals viewing your site and will not be held responsible for these actions.

Client understands that HIT COUNTERS on your site DO NOT ACCURATELY REPRESENT THE NUMBER OF VISITORS SENT TO YOUR SITE. This is due to the large amounts of traffic sent to the site in a relatively short time frame. Client also understands that FavoriteTraffic.com DOES NOT GUARANTEE SALES OR SIGNUPS AND WILL NOT ISSUE A REFUND IF NONE ARE ACHIEVED!

PAYMENT LIABILITY:

FavoriteTraffic.com reserves the right to hold Customer and any agency, broker or other authorized representative of Customer jointly and severally liable for all amounts owed to FavoriteTraffic.com.

MONEY-BACK GUARANTEE:

While we are able to deliver traffic, and we guarantee to deliver targeted traffic, we do not guarantee sales of your product or service. We can guarantee that you will get the traffic you have purchased delivered to your site within the time frame you specify. If FavoriteTraffic.com fails to deliver traffic to your website in the time specified on your original order, you have the option of either requesting that we extend the due date and complete your traffic delivery or we issue you a pro-rata refund on the undelivered portion.

RATES:

All advertising rates are subject to change at any time.

MINIMUM CTR:

FavoriteTraffic.com does not guarantee minimum Click-through Ratio (CTR) for redirected visitors or any other service we provide.

MINIMUM AGE REQUIREMENTS:

This is a legal, binding contract. No person under the age of 18 is allowed to participate in our program unless written permission from a parent or legal guardian, notarized, signed and dated, is sent as an email attachment.

RECURRING MONTHLY TRAFFIC PLANS:
Monthly traffic plans shall be bound by all Terms Of Service (TOS ) as stated on this page. One ( 1 ) month shall be equal to 30 calender days. Client acknowleges that monthly traffic plans are contracted for a minimum of 3 months, beginning on the day when the first visitor sent by FavoriteTraffic.com arrives at your website. You will be rebilled at the account in which you used to purchase the monthly plan(s). After the initial ( 3 ) three month term, all monthly plans will continue on a rebilled, month to month basis, until cancelled by customer or FAVORITETRAFFIC.COM in writing, a minimum of 7 calender days before the next scheduled 30 day period. Any Monthly Campaign cancelled by customer during the first 30 days, will be subject to a cancellation fee equal to 100% of that portion of the campaign scheduled to run during the thirty (30 ) day period following receipt by FavoriteTraffic.com of written cancellation notice from Customer. Any Monthly Campaign cancelled by customer during the ( 2nd month ) second 30 day period, will be subject to a cancellation fee equal to 75% of that portion of the campaign scheduled to run during the following (2nd ) (30 ) day period following receipt by FavoriteTraffic.com of written cancellation notice from Customer. Any Monthly Campaign cancelled by customer during the ( 3rd month ) third 30 day period, will be subject to a cancellation fee equal to 50% of that portion of the campaign scheduled to run during the following (3rd ) (30 ) day period following receipt by FavoriteTraffic.com of written cancellation notice from Customer.

SALES - DISCOUNTS:
Customer may use only one ( 1) sale or discounted price per order.

YOUR PRIVACY:
We respect yopur privacy and do not release any personal information about you., including your email address.

GENERAL:

Client acknowledges that the order is for the stated term. These terms and conditions are subject to change at any time after the stated term has ended.

Client may not sell, assign or transfer any of the rights or services accompanying the purchase. Client may not change the content of the URL being advertised in any manner without prior written approval by FavoriteTraffic.com authorized staff. Any attempt either by accident or design undermining the intention of this T.O.S. or the general principals that it was written for will result in immediate account deletion with no refund or adjustments available.

In the event that there is a discrepancy between the amount of traffic delivered by FavoriteTraffic.com, and the amount of traffic delivered to the Client, on their behalf, FavoriteTraffic.com and the client both agree to use the report prepared by our ("FavoriteTraffic.com") campaign manager to be the official report. The client understands and acknowledges that the campaign report received by FavoriteTraffic.com to be true and accurate and agrees to hold FavoriteTraffic.com, it's parent company as well as all companies and individuals involved harmless for any unexpected results arising from any advertising campaign.

FavoriteTraffic.com shall be permitted to identify Client as a FavoriteTraffic.com Client and may use Client's name in connection with FavoriteTraffic.com marketing materials. Subject to the prior approval of each party, FavoriteTraffic.com may elect to issue a joint press release announcing the Client's marketing partnership with FavoriteTraffic.com, which approval shall not be unreasonably withheld.
